Introduction
These Terms and Conditions (Terms of Use) apply to your use of the travel eSIM service (Service) provided by Lebara Limited, a company incorporated in England and Wales with company number 04293563 with its registered office at 5th Floor, Broadway House, 5 Appold Street, London EC2A 2DA, United Kingdom, and its affiliates (referred to in these Terms of Use as Lebara, we, us, our).
These Terms of Use apply to you, our customer (and referred to in these Terms of Use as you, your). By accessing or using our App or the Service, you agree to comply with these Terms of Use.
The Service
The Service provides mobile data connectivity through an electronic SIM (eSIM) which can be purchased through our App (the Lebara Go App), together with associated data plans to be used with the eSIM. The Service is data-only and for use in supported countries.
Eligibility and devices
You must be at least 18 years old to use the Service.
You need a compatible device that supports eSIM and you are responsible for ensuring your device is compatible.
Accessing and using
You can purchase an eSIM through the Lebara Go App, together with a prepaid data plan to use with that eSIM. We offer different prepaid data plans, which may vary by country or region (subject to availability) and duration and data allowance. A data plan states its:
· Coverage area (e.g. Europe).
· Data allowance (e.g. 5GB).
· Validity period (e.g. 7 days).
· Price.
You are responsible for selecting a data plan that suits your needs.
Upon successful purchase, your eSIM and data plan will be delivered electronically within the Lebara Go App. Installation and activation instructions will be provided at the time of purchase and you are responsible for following those instructions.
An eSIM will remain installed on your device after your data plan has been used up or has expired. Further data plans may be purchased for that eSIM.
Each eSIM is for single-device use and cannot be transferred.
Restriction and Fair Use
The Service is for personal, non-commercial use and fair use policies apply. You agree not to:
· Misuse the Service or use it for illegal, fraudulent, prohibited or harmful activities or otherwise use the Service in breach of applicable law.
· Resell or redistribute the Service.
· Exceed reasonable usage limits (where a data plan has an unlimited allowance).
You are responsible for all activity conducted through your purchased eSim.
Payments
All payments for eSIM and associated data plans are through the Lebara Go App and must be made using Apple Pay.
Data plans are prepaid and charges are payable at the time of purchase.
All prices are shown in GBP (£) on the Lebara Go App and include VAT (or other equivalent sales taxes), unless otherwise stated.
Refunds
If you purchase an eSIM or data plan through the Lebara Go App, you have the right to cancel your order within 14 days of purchase and receive a refund, so long as you have not activated or used that eSIM or data plan.
If the Service that’s provided doesn’t comply with these Terms of Use, or your eSIM or data plan cannot be installed or activated because of a technical issue not caused by your device or your actions, you may be entitled to a replacement or full or partial refund. Please contact us using the contact details set out at the end of these Terms of Use to report any issues or request a refund.
Data and privacy
We may collect usage data and feedback to evaluate service performance and customer experience. You consent to the use of anonymised data for analysis and improvement of the Service.
We collect and process personal data in accordance with applicable data protection laws. Details about the collection of personal data in connection with the use of the Service can be found in Lebara’s Privacy Notice which can be accessed [here[Legal2] ].
Any international transfer of your personal data outside the European Economic Area is subject to various safeguards. Please review Lebara’s Privacy Notice for more information about international data transfers.

Intellectual Property
All content, trade marks, logos, software, and other intellectual property subsisting in the Service and the Lebara Go App and our websites is owned by, or licensed to, Lebara and remains our property or that of our licensors. You may not copy Lebara's names, trademark, pictures, brands or logos.
Limitations
You acknowledge that:
· ESIMs and data plans are subject to availability and device compatibility.
· We’re not responsible for issues arising from device incompatibility, the incorrect installation of an eSIM or from your actions.
· Coverage and speeds may vary depending on our roaming agreements and local network conditions – we do not guarantee connection availability, network quality, capacity or availability in countries that are not supported.
· The Service is provided on an ‘as is’ basis – we do not guarantee uninterrupted or error-free service (the Service is experimental and may contain bugs or limitations).
· We may suspend or restrict the Service in certain circumstances (such as for maintenance).
Liability
To the extent permitted by law:
· We exclude all warranties (whether express or implied).
· We are not liable for any indirect, special, incidental or consequential damages arising from your use of, or inability to use, the Service.
· Our total liability to you shall not exceed the amount you paid for the affected Service.
Termination
We may suspend or terminate your access to the Service and disqualify you from future use if you breach these Terms of Use.
We reserve the right to discontinue the Service and the sale of eSIMs and data plans at any time for our own operational reasons. The Service may be provided for a limited time only.
You may stop using the Service at any time, but no refunds will be issued.
Changes to these Terms of Use
We may amend or update these Terms of Use from time to time and will post any material changes on the Lebara Go App or on our websites. Your continued use of the Service constitutes your acceptance of updated terms.
Governing Law
These Terms of Use are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
